For over twenty years, Rebecca Sposita has stood on the front lines of advocacy. As an attorney handling complex medical malpractice and sexual assault cases – including work for survivors of Larry Nassar – she witnessed a recurring, painful pattern.

It wasn’t just the original injury that harmed her clients; it was the “secondary assault” of being met with defensiveness, denial, and a lack of humanity from the organizations they trusted.

The Turning Point

In 2022, while serving as President of Sam Bernstein Law , Rebecca stepped into a different role: a student at Harvard Business School. While there, she experienced an incident that required a formal report.

For the first time in her decades-long career, she wasn’t the advocate, she was the person coming forward. She felt the profound weight of the process and realized that even prestigious institutions often lack a trauma-informed framework for handling high-stakes complaints.

A Better Way Forward

Instead of walking away, Rebecca collaborated with administrators to improve their systems, leading to real-world changes in how they handle such reports.

This journey was the foundation of Win-Win. She realized that protecting an organization and treating a person with dignity are not opposite goals.

By utilizing the Win-Win framework, leaders can mitigate legal risk while actually strengthening their culture and trust.

When institutions fear that addressing the problem or admitting responsibility will guarantee a costly lawsuit, the tendency is to do nothing and wait for the problem to disappear...
